POLICY

The university will respond to and defend all workers' compensation claims filed against it whereby an Application for Mediation or Hearing has been filed with the Bureau of Workers' Disability Compensation naming the university as defendant.  Written internal procedures have been developed jointly by the Office of Risk Management and the Office of General Counsel for the administration of this type of claim.

SUBROGATION

POLICY

It is the university's policy to subrogate to recover any funds to which it is entitled.  The university seeks to recover funds equal in amount to workers' compensation benefits paid to injured employees as a result of injuries sustained in the course of their employment with the university but caused by another party.  The targeted funds are those paid to the injured employees by third-party defendants by way of settlement or a court decision.  Written internal procedures have been established between the Office of Risk Management and the Office of General Counsel to facilitate recovery of these funds.
