99-4 Approval Of Personnel Actions (Third Release)

1.0  Purpose

1.1     The Board of Governors has delegated to the president, in section 2.2 of the bylaws, full authority as chief executive officer of the University and has, in addition, authorized the president to designate the duties of other executive officers.

1.2     The Board of Governors, in the statute on approval of Personnel Actions (Official Proceedings, January 14, 1983, 3373) has specifically delegated to the president the authority to approve certain personnel actions and has authorized the president to subdelegate this authority:

The Board of Governors reserves solely to itself the authority to (1) grant continuing tenure, (2) award the rank of (full) professor, and (3) approve a non-scheduled salary awarded simultaneous with a grant of tenure or award of the rank of (full) professor . . . and to appoint vice presidents, deans and other executive and administrative officers of equivalent rank . . . . The Board of Governors delegates to the president the authority to make and approve all other personnel actions.

The purpose of this University Policy is to delegate to the Provost, Executive Vice President and Chief of Staff, Vice Presidents, and Secretary to the Board of Governors the authority to approve personnel actions for certain positions within their respective divisions or areas, subject to such limitations as are provided in this university policy and by University statutes.

 

2.0  Verification Of Budget, Posting, And Appointments

2.1     Verification of Budget.  All full-time appointments will require initial approval by the Provost or the Associate Vice President for Human Resources or their designee(s).  This will be to verify that funds are available in the hiring unit's budget to cover the position at the salary that is being offered.  No position is to be approved without this verification.

2.2     Posting.  All positions must be posted as prescribed by the University Policy 1999-05 (Third Release), Position Posting.  Position postings are prepared by hiring managers within the units and submitted for review and approval to the appropriate divisional authority. 

2.3     Selection and Appointment.  Once a candidate is selected for a position, appointments are to be made by letter of offer, except for classifications in section 2.3.3 below. 

2.3.1  Positions Subject to the Pleasure of the President

Appointments of persons who serve subject to the pleasure of the president are to be made by the president or by the persons so delegated in section 3.2.  Appointments must be made by letters of offer utilizing the standard language, format and process approved and maintained by the Executive Vice President and Chief of Staff or his/her designee.  The letter of offer shall be signed by the person authorized by this University Policy to make the appointment.

The Executive Vice President and Chief of Staff or his/her designee will coordinate the appointment process by ensuring that appropriate University policy and procedure has been met.

2.3.2  Positions covered by the AAUP Agreement and Comparable Classifications

 Appointment of all persons covered by the AAUP Agreement or comparable classification shall be made by the Provost or his/her designee.  The Provost will coordinate the appointment process by ensuring that all appropriate University policies and procedures have been met.  Appointments must be made by letter of offer which shall be signed by the Provost or his/her designee.  The Provost is vested with sole authority to make formal employment commitments to persons in this category, except for those classifications sub-delegated in University Policy 2001-2. 

2.3.3  Nonrepresented Clerical Positions and All Represented Employees (except positions in the previous paragraph)

Appointment of all persons in this category will be made by the senior officer of the hiring division.

 

The Associate Vice President for Human Resources or his/her designee will coordinate the selection and appointment process by ensuring that all appropriate University policy and procedure has been met.

 

3.0  Delegation Of Authority

3.1   The Provost is hereby delegated authority to make appointments of persons in positions that are represented by the AAUP Agreement, GEOC-AFT Agreement, and in other academic classifications in the Academic Affairs Division.

3.2    The  Provost and Vice Presidents  are hereby delegated authority to appoint persons who serve in positions designated subject to the pleasure of the president in their respective divisions and are delegated authority to subdelegate in writing to associate vice presidents, assistant vice presidents, deans, and directors the approval of appointments within their respective divisions. 

 

4.0  Limitations

4.1     Any person appointed to a nonrepresented managerial position, and any person appointed to any other position so designated by the Provost or Vice Presidents or their designee(s) shall serve "subject to the pleasure of the president," and all appointment papers for such persons shall specify appointment on that basis.  Failure specifically to provide that language in appointment papers shall not constitute an appointment for a fixed or indefinite term or any term whatsoever.  It shall be a condition of appointment to these positions that appointees shall serve as at-will employees "subject to the pleasure of the president" and that condition shall be deemed incorporated, whether specified or not, in any appointment to these positions.

 

5.0  Reporting

5.1     When required by statute, personnel actions for salaried personnel shall be reported to the Board of Governors by the appropriate University office.

 

6.0  Duration

6.1     This delegation of authority is revocable at any time at the discretion of the president and without notice.

6.2     This University Policy supersedes University Policy 1999-04, Second  Release.

 

7.0  Effective Date

7.1     This University Policy is effective upon issuance.
