3.0.2.1.2 Formal Complaints

DESCRIPTION

Wayne State University is committed to a policy of non-discrimination and equal opportunity in all of its operations, employment opportunities, educational programs and related activities.

It is the purpose of this policy to implement the university's complaint procedures as outlined in University Policy 05-3 Discrimination and Harassment Complaint Process.

TERM(S)/DEFINITION(S)

Complainant

A statement alleging discrimination or harassment because of a basis protected by university policy.

Complainant

The individual who makes the discrimination complaint.

Executive Officer

The vice president or dean the division or unit where the complaint originated.

Respondent

The person or unit who is accused of violation of the university policies prohibiting discrimination/harassment.

POLICY

The policy sets forth the mechanism for processing allegations that the university's Non-Discrimination and Sexual Harassment policies have been violated. The filing of a formal complaint results in an investigation being conducted by the Office of Equal Opportunity (OEO). At the conclusion of the investigation, a Notice of Disposition is completed with a finding as to whether there has been a violation of the university's Non-Discrimination and Sexual Harassment policies.

A formal complaint must be signed and dated by the complaining individual(s) ("the complainant").  The filing of a formal complaint requires a full investigation by the OEO and the development of findings of fact and formal recommendations regarding disposition of the complaint.

The OEO will provide the person or unit who is accused of violation of the university policies prohibiting discrimination / harassment ("the respondent") a copy of the formal complaint and provide the respondent with an opportunity to provide a written response within the time limits set by the Office of Equal Opportunity.

  1. Investigate complaint by gathering information and supporting documentation from appropriate WSU personnel.

  2. Notify executive officer in the division or unit that a formal complaint was filed.

  3. Prepare Notice of Disposition and include:

    1. Summary of complaint.

    2. Statement of findings

    3. Statement of conclusion

    4. Statement of any recommendations

  4. Notify the parties of completion of the investigation.
